Items of Urgent Business

To receive additional items that the Chair is of the opinion should be considered as a matter of urgency, in accordance with Section 100B (4) (b) of the Local Government Act 1972.

Minutes:

There were no items of urgent business.

13.

Declarations of Interests

Minutes:

Councillor Collins highlighted that the Applicant 1 lived within his Ward and sought if the Applicant was happy to continue. The Applicant agreed that he was.

 

Exclusion of the Public and Press

 

Members of the Sub-Committee agreed that, in accordance with Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business, on the grounds that they could involve the possible disclosure of exempt information as defined in paragraph1 (Information relating to any individual) of Schedule 12A of that Act.

 

The Chair agreed to hear Application 1 and Application 2 at the same time as both related to the same substantial facts and vehicle.

Determination of a Hackney Carriage/Private Hire Driver Licence

Minutes:

The Chair asked all parties if they had any requests, and it was noted that there were no requests.

 

The Licensing Officer introduced the reports to Members of the Sub-Committee informing them, the reports were a Determination of a Hackney Carriage/Private Hire Driver Licence.

 

Members and the applicants were provided with the chance to ask questions of the Licensing Officer.

 

The Applicants were then provided with the opportunity to present their cases.

 

Members and the Licensing Officer were given an opportunity to ask questions to the applicants.

 

Following questions from Members, the Chair moved on to closing summaries.

 

The Licensing Officer provided a short summary to the Sub-Committee. She remarked that Members of the Sub-Committee had read the reports and heard submissions from both Licensing Officers and the Applicants and it was therefore for the Committee to decide whether the applicants were fit and proper persons to hold a Hackney Carriage/Private Hire Driver’s Licence.

 

The Chair asked if there were any further questions, there were none.

 

The Sub-Committee adjourned at 7.30pm for deliberation and were accompanied by the Legal Advisor and the Democratic Services Officer. 

 

The meeting reconvened at 7.47pm

 

RESOLVED:

 

That the Licensing Sub-Committee granted the Licence but with a two week suspension for both parties.

15.

Determination of a Hackney Carriage Vehicle Licence

Minutes:

The Chair asked all parties if they had any requests, and it was noted that there were no requests.

 

The Licensing Officer introduced the reports to Members of the Sub-Committee informing them the report was an a application for a Determination of a Hackney Carriage Vehicle License.

 

Members and the applicant were provided the chance to ask questions of the Licensing Officer.

 

The Applicant was then provided with the opportunity to present her case.

 

Members and the Licensing Officer were given an opportunity to ask questions to the applicant.  

 

The Chair moved on to closing summaries.

 

The Licensing Officer provided a short summary to the Sub-Committee. She remarked that Members of the Sub-Committee had read the report and heard submissions from both Licensing Officers and the Applicant and it was therefore for the Sub-Committee to decide whether there was good reasons to depart from the policy and to deem the vehicle suitable to be licenced as a Hackney Carriage vehicle.

 

The Chair asked if there were any further questions, there were none.

 

The Sub-Committee adjourned at 8.01pm for deliberation and were accompanied by the Legal Advisor and the Democratic Services Officer. 

 

The meeting reconvened at 8.14pm.

 

RESOLVED:

 

That the Licensing Sub-Committee agreed under exceptional circumstances to depart from the policy and grant the renewal application.
