To receive additional items that the Chair is of the opinion should be considered as a matter of urgency, in accordance with Section 100B (4) (b) of the Local Government Act 1972.

There were no items of urgent business.

There were no interests declared.

Councillor Redsell highlighted that the Applicant for the first hearing (minute 8) lived with her Ward; however, she did not know him personally. The Chair sought if the Applicant was happy to continue. The Applicant agreed that he was.

Exclusion of the Public and Press

 Members of the Sub-Committee agreed that, in accordance with Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business, on the grounds that they could involve the possible disclosure of exempt information as defined in paragraph1 (Information relating to any individual) of Schedule 12A of that Act.

The Chair asked all parties if they had any requests, and it was noted that there were no requests.

The Licensing Officer introduced the report to Members of the Sub-Committee informing them, the report was a new application for determination of a Private Hire Driver Licence.

Members and the applicant were provided the chance to ask questions of the Licensing Officer. There were none.

The Applicant was then provided with the opportunity to present his case.

Members and the Licensing Officer were given an opportunity to ask questions to the applicant. There were none from the Licensing Officer.

Following questions from Members, the Chair moved on to closing summaries.

The Licensing Officer provided a short summary to the Sub-Committee. She remarked that Members of the Sub-Committee had read the report and heard submissions from both Licensing Officers and the Applicant; it was therefore their decision to decide if Mr Anderson was a fit and proper person to hold a taxi licence.

The Applicant was asked to present a summary of their case to Members; he said stated that he was sorry for the incident and it would not happen again. He further thanked the Sub-Committee for their time.

The Chair asked if there were any further questions, there were none.

The Sub-Committee adjourned at 7.10pm for deliberation and were accompanied by the Legal Advisor and the Democratic Services Officer.

RESOLVED:

That the Licensing Sub-Committee granted the Licence for a period of one year.

The Applicant’s representative stated she was a family friend and had know the applicant for a number of years, who she trusted with her life. She mentioned the he had made a mistake but was trying to move on and provide for his daughter.

Following questions from Members, the Chair moved on to closing summaries.

The Licensing Officer provided a short summary to the Sub-Committee. She stated that Members of the Sub-Committee had read the report and heard submissions from both Licensing Officers and the Applicant; including comments from the Police, it was therefore their decision to decide if the Applicant was a fit and proper person to hold a taxi licence.

The Applicant was asked to present a summary of their case to Members; he said he was an honest and kind-hearted person and he just wanted to be able to do the best for his daughter. 

The Chair asked if there were any further questions.
