The Chair sought if the Applicants were happy to hold each item together as they were all involved in the incident which brought them before the Sub-Committee. The Applicants confirmed they were happy to hold their hearings at the same time. |

Review of a Hackney Carriage / Private Hire Driver Licence Minutes: The Chair asked all parties if they had any requests, and it was noted that there were no requests.
The Licensing Officer introduced the report to Members of the Sub-Committee informing them all three applicants received a conviction for assault occasioning actual bodily harm, which put them outside the Council’s Statement of Policy and Guidelines relating to the relevance of Convictions, Formal / Simple Cautions, Complaint and / or other matters. The applicants also failed to declare the charge / conviction in accordance with the conditions of their licences.
Members and the applicant were provided the opportunity to ask questions of the Licensing Officer.
The applicant for Item 5 was then provided with the opportunity to present his case.
Members and the Licensing Officer were given an opportunity to ask questions to the applicant. There were none from the Licensing Officer.
Following questions from Members, the Sub-Committee adjourned at 7:28pm for Members to seek Legal advice and were accompanied by the Legal Advisor and the Democratic Services Officer.
The meeting reconvened at 7.35pm,where the Chair informed those present that the Sub-Committee would be adjourned to the first meeting of the new year and explained the reasons for this.
RESOLVED:
That the Sub-Committee be adjourned to the first meeting of the New Year.

Review of a Hackney Carriage / Private Hire Driver Licence
The Chair welcomed all parties and explained that the previous hearing held on 6 December 2016 was adjourned.
The Legal Adviser addressed the Sub-Committee explaining that at the last hearing all parties had stated their cases.
The Chair of the Sub-Committee sought if Members had any further questions. There were none. He then asked if all applicants were happy to continue as one hearing as they had agreed previously. It was agreed to continue the hearing as one.
He then moved on to closing summaries.
The Licensing Officer provided a short summary to the Sub-Committee. She explained it was therefore up to the Sub-Committee to decide if all three drivers were fit and proper people to hold a licence.
The applicants were asked to present their summary of their case to Members, during which each applicant spoke to the Sub-Committee.
The Chair asked if there were any further questions, there were none.
The Sub-Committee adjourned at 7.14pm for deliberation and were accompanied by the Legal Advisor and the Democratic Services Officer.
The meeting reconvened at 7.27pm.
RESOLVED:
That all three licences are revoked.
